Investigative Questions
In this section of the test, you will be given a paragraph which describes an incident or problematic
situation. Following the paragraph will be up to ten witness statements that were taken during the investigation.
After reading the paragraph and the witness statements, you will have to answer several questions concerning the
witness statements as they pertain to the investigation. Carefully read the witness statements. You should ask
yourself if these statements are based on fact or is the person giving their opinion as to what happened. Read
the answers and compare them to each other to see which statement answers the question.
Investigative Sample Question A
On August 2, 1996, an Illinois State Trooper made a traffic stop on a blue Dodge Caravan that
was owned and driven by Thomas Davis. Traveling in the van with Davis was Jim Barnes. The Trooper
observed a small amount of cocaine in the van and arrested both individuals for possession of cocaine.
On August 29, 1996, Davis and Barnes pled guilty to the charges. Davis was placed on probation for two
years and Barnes was sentenced to serve two years at a prison camp in Terre Haute, Indiana. After
serving six months of his sentence, Barnes was assigned to work the maintenance detail which allowed
him to work outside with minimal supervision. On May 22, 1997, the prison conducted its usual head
count at 10:00 p.m. At that time, it was discovered that Jim Barnes was no longer at the institution
and he was declared as an escapee. On May 25, 1997, Jim Barnes was arrested by the U.S. Marshals in
Springfield, Illinois.
An investigation by the U.S. Marshals Service as to how Jim Barnes was able to escape and if he
received any assistance in escaping yielded the following statements:
1. Correctional Officer Bob James stated that on May 22 he assigned Jim Barnes along with five other
inmates to trim some trees located behind the prison camp. James recalled seeing Barnes still working
at around 4:30 p.m. At 5:00 p.m. when they stopped working, several inmates told Officer James that
Barnes had entered the prison building to use the bathroom.
2. Thomas Davis who resides at 512 Sandgate, Springfield, Illinois stated that he has known Jim Barnes
since childhood. Davis said he has written to and telephoned Barnes numerous times since his incarceration.
3. Correctional Officer Troy Thompson stated that on May 22 at around 4:45 p.m. inmate Jim Barnes entered
the prison complex and said that he was quitting early because he was not feeling well. He allowed Barnes
to go to his cell unescorted.
4. Deputy U.S. Marshal Ed McGrath stated that while searching Barnes cell he found a letter Barnes had
received from an unknown individual. In the letter was the phrase, May 22 is good. The letter was
postmarked May 15, 1997, Springfield, Illinois.
5. Inmate David Jones stated that he was working with Barnes on May 22. Sometime after 4:30 p.m. Barnes
told him he was going inside to use the facilities. That was the last time he saw Barnes.
6. Shirley Kerns who is a neighbor of Thomas Davis stated that Davis usually drives his truck everywhere
he goes and rarely drives his van. The van has been sitting in front of his house for approximately
four months without being driven. She believes the van is not running.
7. Deputy U.S. Marshal Jeff Sharkey stated that when he arrested Barnes, Barnes peacefully surrendered.
8. Correctional Officer Daryl Jennings stated that around 5:05 p.m. on May 22, 1997 he saw a blue van
driving down the access road located behind the prison camp. Jennings could not tell who was in the van.
9. Inmate Jerry Hines stated that at around 6:30 p.m. he asked Correctional Officer Thompson if Barnes
was ok. Officer Thompson told him that Barnes was feeling better.
10. Robert Cowens who is a neighbor of Thomas Davis stated that on May 22, 1997 at around 10:00 p.m. he
observed two men entering Daviss house.
